Senior Non-Key Expert (Snke) To Prepare A Proposal To Update Decree 7993, Which Concerns The Organization Of Trade Unions

JOB DESCRIPTION The EU-funded Project “Promotion of Social Dialogue in Lebanon” is aiming to enhance the capacity of the Government of Lebanon and the Lebanese Social Partners and Civil Society to be promoters of Social Dialogue in order to strengthen social protection and improve and enforce labour legislation.This project is part of the EU funded program “Promotion of Social Justice”, which follows a comprehensive approach to human development in supporting increased access to information, enhanced participation of citizens in decision making and advanced social protection in support of inclusive and sustainable growth.The project is implemented by the Ministry of Labour (MoL). Beneficiaries and partners of the project are the MoL- especially the Labor Inspection Department of the MoL- , the National Employment Office (NEO), the Economic and Social Council (ECOSOC), Employer Organizations, Trade Unions, Civil Society Organizations and other relevant stakeholders involved in Social Dialogue. Objectives and scope of works for the Senior Expert: SNKE (20 w.d.) The overall objective of this assignment is to deliver a cohesive concept for the modernization and reform of Decree number 7993 under the auspices of the MOL.   This concept will inform discussions in the relevant Working Group (WG) (under the Component 1.2 (as per Project Operations Plan); the WG will be chaired by the MOL and will consist of selected representatives from the spectrum of Social Partners: Trade Unions, Employers, Associations/ Federations as well as Civil Society representative platforms.   Works will comprise the following activities:   In close collaboration with the TL and KE3 (legal expert), the Senior NKE will: Analyse the present system and going practice of Trade Unions in Lebanon; Analyse and review the existing regulations of the Decree 7993; Draw conclusions on the actual status quo and share these with the relevant Working Group (in a workshop session) for validation of the proposed reformed legal clauses and their possible modification; Jointly with the inputs from the KE3 and the Junior NKE discuss the modifications of the legal framework in a series of workshops (up to 6) with the tripartite social partners including a discussion on a strategic approach how to ensure promulgation of the revised legal framework to ensure its implementation. This list may not be exhaustive, and additional works (similar to the nature of this assignment) may be requested by the TL. Methodology In close collaboration with the TL, the Senior NKE will: Review pertinent / relevant sources of information related to Trade Unions modernisation development (international, regional and national); Present relevant sources in the form of informative readers (abstracts, diagrams etc.) for background information of workshop participants; Develop a clear-cut operations analysis of the going practices in Trade Unions in Lebanon for validation in the Workshop(s) by the WG; Provide conceptual inputs for the WG (see no. 2. above) and related workshop preparations, jointly with the KEs of the TAT, covering both contents and methodologies; Jointly with the KEs partake in workshop preparations and organisation, and provide support to the relevant WG; Organise and make presentations in workshop sessions; Document (in writing and printing) all works providing evidence (as reports) in soft and hard copies. Deliverables The usual place of provision of discharge of services is the Project office at the premises of Economic & Social Council (ECOSOC) in Downtown Beirut.  The deliverables are as follows: The Senior NKE will present an implementation concept for validation by the TL and MoL that clearly lays-out all the works to be undertaken under the consultancy, including information sharing in up to 6 workshops with the WG; these will be supported by Power Point Presentations (PPT); Status quo report: description and analysis of the status-quo of Trade Unions and documentation, revealing any perceived gaps; Review, analyze and identity the gaps of the existing legal framework for Trade Unions in consultation with relevant stakeholders. Prepare and present relevant sources in the form of informative readers (abstracts, diagrams etc.) for background information of workshop participants; Organize the WG and conduct up to 6 training and consensus building sessions  related to the proposed changes of the existing decree and selected components governing the relations of the Trade Unions. Together will KE3, update existing Decree 7933, including mechanisms for mediation in work conflicts, and share draft revision with MoL and social partners. Support WG consultation process through at least 1 wide conference combined with a  media event for conclusion of the consultations. PPT presenting the findings of the mission and validation of the proposal by the WG on Trade Unions; A final report covering all works (outputs) and key results of discussions for submission to the Team Leader. Time line: Works shall be implemented in the period from April 2017 to June 2017 (indicative). Language: All documents are to be provided in English (of these, the Project will translate a selection into Arabic). Qualification and experience Qualification and key competences: Master degree in Law, Public Administration, Political Science, Sociology or other relevant social area, preferable specializing in Trade Unions / Labor Law or a Bachelor degree with five (5) years of additional relevant professional experience, directly related to Trade Unions and / or Labor Law Excellent verbal and written communication skills in English & Arabic Demonstrated excellent writing and editing skills in English and Arabic;  Excellent verbal and written command of French will be an asset Strong interpersonal and communication skills Strong analytical and organizational skills Application of the consulting approaches, including workshop moderation in capacity development Professional experience: Minimum of eight (8) years of professional experience in areas related to Public Administration, Trade Unions, Labour Law, or other relevant social area; Minimum one work experience in public sector law reform Work experience in ENPI country in related field is an asset Familiar with the National scene and underlying currents in Social Dialogue, verified by track record of works, including publications;
