Objectives and scope of works for the Senior Expert: SNKE (60 w.d.)
The overall objective of this Request for Proposal of Services is to deliver a cohesive concept for the modernization and reform of the LI Services under the auspices of the Ministry of Labour-MOL, including the application of the full range of ICT-based data management and tools. The consultant will lay-out a full concept to ensure that efficiency gains through application of these modern tools will lead to more optimized inspections and, ultimately to improved compliance in the workplaces of Lebanon.
This concept will inform discussions in the relevant Working Group (WG) (under the Component 1.3 and 2.1 (as per Project Operations Plan); the WG will be chaired by the MOL and will consist of selected representatives from the spectrum of Social Partners: Employers, Trade Unions Associations/ Federations as well as Civil Society representative platforms.
Works will comprise the following activities:
In close collaboration with the TL, and assistance from the Junior NKE, the Senior NKE will:
Analyse the present system and going practice of Labour Inspections (with support from the Junior NKE) in Lebanon, including the focus on data processing and storage;
Review going practices with LI data generation, inter alia: tracking cases of non-compliance, dealing with complaints, monitoring the LI performance by using data bases, web-based platforms and mobile devices;
Develop concept proposals demonstrating how to transform existing practices to the new administration processes, including cost considerations and maintenance of the systems, also addressing security concerns about the protection of the data and ensuring confidentiality of data;
Draw conclusions on the actual status quo and share these with the relevant Working Group (in a workshop) for validation and possible modification;
(Based on desk research:) Review regional and EU practices in LI with a view to identify regional partner(s) for knowledge sharing and peer learning;
Demonstrate the benefits of modernized LI in terms of identification of trends and impacts of LI in improving work places compliance (e.g. by complaints tracking, giving feedback to workers on their lodged complaints); management of follow-up visits; other benefits such as reduced underreporting; improvements in LI planning, and others;
Jointly with the inputs from the Junior ICT specialised NKE prepare a costed proposal for the full transition to a modernized LI system (to be tabled for mobilization of financial resources);
Liaise with the Office of the Minister of State for Administrative Reform (OMSAR) on the relevant issues.
This list may not be exhaustive, and additional works (similar to the nature of this assignment) may be requested by the TL.
. Methodology
In close collaboration with the TL, the Senior NKE will:
1) Review pertinent / relevant sources of information of LI modernisation development (international, regional and national);
2) Present relevant sources in the form of informative readers (abstracts, diagrams etc.) for background information of workshop participants;
3) Develop a clear-cut operations analysis of the going practices in LI in Lebanon for validation in the Workshop(s) by the WG;
4) Make conceptual inputs to Working Group (see no. 2. above) and related workshop preparations, jointly with the KEs of the TAT, covering both contents and methodologies;
5) Jointly with the KEs partake in workshop preparations and organisation, and provide support to the relevant WG;
6) Organise and make presentations in workshop sessions;
7) Document (in writing and printing) all works providing evidence (as reports) in soft and hard copies.
. Deliverables
The usual place of provision of discharge of services is the Project office housed within the Ministry of Labour Building, 6th floor, Chiyah, Beirut.
The deliverables are as follows:
The Senior NKE will present an implementation concept for validation by the TL and MoL that clearly lays-out all the works to be undertaken under the consultancy, including information sharing in workshops with the WG; this will be supported by a Power Point Presentation (PPT);
Description and analysis of the status-quo of LI and documentation, jointly with the Junior NKE, revealing any perceived gaps;
A full proposal for a modernized LI system that utilizes modern/recent ICT tools and data management, and its transition from the present system to the new one; the concept must clearly address the need to provide a solid degree of realism and pragmatism, driven by a sense of prioritization; this must fully supported by the Partners in the MOL Labour Inspection Department (see next deliverable, validation);
Power Point presentation presenting the findings of the mission and Validation of the proposal by the WG on LI;
A costed plan for the agreed transition to the modernized agreed system, with suggestions on the financing and resource mobilisation;
A final (Draft) report covering all works and discussions for submission to the Project.
. Time line: Works shall be implemented in the period December 2016 to June 2017 (indicative).
. Language: All documents to be provided in English (of these, the Project will translate a selection into Arabic).
. Qualification and experience
Qualification and key competences:
University degree: Masters level in Public Administration, possibly specializing in Labour Inspection, labour law, or other relevant social area;
Excellent verbal and written communication skills in English and Arabic;
Excellent writing and editing skills in English and Arabic;
Strong interpersonal and communication skills;
Strong analytical and organizational skills;
Application of the consulting approaches, including workshop moderation in capacity development.
Professional experience:
Minimum of eight years of professional experience, preferably in areas related to Public Administration, Labour Inspection, laour law, or other relevant social area;, or web- based platforms and mobile devices;
Minimum one work experience in public sector
Work experience in ENI country in related field is an asset
Knowledge of ICT data management is an asset.
