Senior Non-Key Expert (Snke)- Legal Services : Prepare A Draft Of New Labour Regulations For Labour Inspectors

Objectives and scope of works for the Senior Expert: SNKE (20 w.d.) The overall objective of this Request for Proposal of Services is to deliver a cohesive concept for the modernization and reform of the LI Services under the auspices of the Ministry of Labour-MOL, including the review of the full set of legal norms applicable to facilitate modern inspection services, aligned to state-of-the-art standards. In close collaboration with the National Senior Key Expert (component 3) the SNKE will review existing legal norms governing the works and missions of the Labour Inspectors. This will include comparative analyses with international and regional norms and practices, and eventually help to identify existing gaps in the legal framework. It is important that the works will be fully communicated to the Working Group under this component in order to ensure later promulgation and application of the legal framework. The works of the consultant will lay-out a full concept to ensure that efficiency gains through application of the modernized legal framework will lead to more optimized inspections and, ultimately to improved compliance in the workplaces of Lebanon. This concept will inform discussions in the relevant Working Group (WG) (under the Component 1.3 and 2.1 (as per Project Operations Plan); the WG will be chaired by the MOL and will consist of selected representatives from the spectrum of Social Partners: Employers, Trade Unions Associations/ Federations as well as Civil Society representative platforms. Works will comprise the following activities: In close collaboration with the KE 3, and assistance from the Junior NKE, the Senior NKE will: Analyse the present system and going practice of Labour Inspections (with support from the Junior NKE) in Lebanon, including the focus on legal gaps impacting on professional works (comparable to international standards); Draw conclusions on the actual status quo and share these with the relevant Working Group (in a workshop) for validation and possible modification; (Based on desk research:) Review regional and EU legal norms and compare with the Lebanese framework with a view to identify the gaps and weaknesses in the present legal norms; Develop a modernized legal framework demonstrating strengths of the proposed new system. This list may not be exhaustive, and additional works (similar to the nature of this assignment) may be requested by the TL. .  Methodology In close collaboration with the KE 3, the Senior NKE will: 1)      Review pertinent / relevant sources of information of LI modernisation development (international, regional and national); 2)      Present relevant sources in the form of informative readers (abstracts, diagrams etc.) for background information of workshop participants; 3)      Develop a clear-cut operations analysis of the going practices in LI in Lebanon for validation in the Workshop(s) by the WG; 4)      Make conceptual inputs to Working Group (see no. 2. above) identifying the present gaps in the legal framework; 5)      Jointly with the KE 3 and JNKE for this component partake in workshop preparations and organisation, and provide support to the relevant WG; 6)      Organise and make presentations in workshop sessions; 7)      Document (in writing and printing) all works providing evidence (as reports) in soft and hard copies.  . Deliverables The usual place of provision of discharge of services is the Project office housed within the Ministry of Labour Building, 6th floor, Chiyah, Beirut. The deliverables are as follows: The Senior NKE will present an implementation concept for validation by the KE 3 and MoL that clearly lays-out all the works to be undertaken under the consultancy, including information sharing in workshops with the WG; this will be supported by a Power Point Presentation (PPT); Review, analyze and identification of the gaps in the existing labour inspection regulations; Written report reflecting the discussions of the workshops; Draft final regulation for LI and submission to the Authorities for promulgation; Power Point presentation presenting the findings of the mission and Validation of the proposal by the WG on LI; A final (Draft) report covering all works and discussions for submission to the Project. . Time line: Works shall be implemented in the period December 2016 to June 2017 (indicative).  . Language: All documents to be provided in English (of these, the Project will translate a selection into Arabic).  . Qualification and experience Qualification and key competences: University degree: Masters level in Public Administration, possibly specializing in Labour Inspection, labour law, or other relevant social area; Excellent verbal and written communication skills in English and Arabic; Excellent writing and editing skills in English and Arabic; Strong interpersonal and communication skills; Strong analytical and organizational skills; Application of the consulting approaches, including workshop moderation in capacity development. Professional experience: Minimum of eight (8) years of professional experience, preferably in areas related to Public Administration, Labour Inspection legal framework, labour law, or other relevant social area; Minimum one work experience in public sector; Work experience in ENPI country in related field is an asset.
