منذ أجل طويل والجدل قائم حول موضوع تعرّض حقوق المرأة - الزوجية منها بشكل خاص - للانتهاك، بحيث انقسم المجتمع الدولي إلى معسكرين: أحدهما يعترف بوجود التمايز والانتهاكات على حساب النساء، والثاني ينفيه.
