Desktop Study For Rights Of Migrants Program (Lrc And Ifrc)

Desktop study purpose The overall purpose of this desktop study is to provide a comprehensive literature review and analysis to illustrate the situation of migrants with attention to the level of protection of their rights and highlighting the prevalence of and underlying causes for human trafficking and labour migration for domestic work purposes. Desktop study objectives A comprehensive country desktop and literature review will be conducted covering, at a minimum, the following objectives (topics):   A.    Situation of migrants: Main trends and data on migration, with a particular focus on labour migration for domestic work and human trafficking. The objective of this section is to identify, collect and summarize available statistics, data and trends in order to provide a brief overview of the country’s migration situation. Information should consider gender dimensions and other demographic considerations of potentially marginalized populations, and data should be disaggregated accordingly. Estimates[1] of number of immigrants and countries of origin. Estimates[2] of number of emigrants and countries of destination. Estimates[3] of number of victims of human trafficking, routes and forms of exploitation, and relevant demographic characteristics. Estimates[4] of number of migrant workers (regular and irregular) and their personal and labour characteristics, with focus on migrant domestic workers. Availability and quality of official sources of information on victims of human trafficking and migrant domestic workers (census, labour force and other surveys, administrative registers). A.    Protection of Migrants: Relevant domestic legal and policy framework on migration. The objective of this section is to identify and briefly describe laws, regulations and policies applicable to migrants; in particular, victims of trafficking and migrant domestic workers. Relevant studies should be identified (if available) and  interviews with relevant stakeholders undertaken (refer to methodology).   ü  Regulatory framework of anti-trafficking, including  protection and assistance measures (if available). ü  Regulatory framework of labour migration with particular focus on migrant domestic workers, identifying if migrant domestic workers are covered by the same regulations as national DWs. ü  New regulations as well as changes to existing policy framework that would apply to or otherwise affect victims of human trafficking and migrant domestic workers. ü  Complaint or grievance mechanisms and access to justice system for victims of human trafficking and regular and irregular MDWs. A.    Assistance to migrants: humanitarian assistance, access to public social services and social inclusion. The objective of this section is to identify and briefly describe the governmental and non- governmental measures to provide humanitarian assistance, access to services and social inclusion of migrants; in particular,  victims of human trafficking and migrant domestic workers. Relevant studies and surveys should be identified (if available) and  interviews with relevant stakeholders undertaken (refer to methodology).   ü  Governmental measures to assist migrants; in particular, victims of trafficking and migrant domestic workers facing risk and abuses, including consular assistance, access to public social services such as healthcare, legal and psychosocial assistance, hotlines, legal assistance, training, repatriation and reintegration, etc. ü  Non-governmental measures to assist migrants; in particular, victims of trafficking and migrant domestic workers, facing risk and abuses, including hotlines, legal assistance, psychosocial support, housing, fist aide care, reception centres, training, repatriation and reintegration, etc. ü  Governmental and non-governmental measures to promote social inclusion and integration of migrant population. ü  Degree of coordination and collaboration between different governmental and non-governmental organizations working to assist migrants and victims of human trafficking.  A.    Perceptions: General public, migrants and other relevant stakeholders views towards migrants and their rights. The objective of this section is to identify the perception of the general public, migrants and relevant stakeholders toward migrants and their rights, with particular focus on victims of trafficking and migrant domestic workers. Relevant studies, surveys and poll should be identified (if available),  media covering monitoring and  interviews with relevant stakeholders undertaken (refer to methodology).  A.    Relevant stakeholders: Mapping of key institutions, actors and services related to migrants and   in particular victims of human trafficking and migrant domestic workers. The objective of this section is to identify main actors involved in policy making and policy agenda on protection and assistance measures for victims of human trafficking and labour migration with focus on migrant domestic workers. I.               Methodology The methodology for this study will combine review of secondary data with key informant interviews.   ü  Researchers will collect information from relevant secondary data sources and official documents. A bibliographic review and analysis of these sources will be prepared as an Annex. ü  Interviews will gather relevant stakeholders views on the opportunities and challenges in the national legislation, polices, regulations and complaint mechanism to protect migrants and in programmes and measures to provide migrants with humanitarian assistance, access to public social services and social inclusion.   ü  Governmental institutions adopting and implementing migration related regulations and policies, receiving complaints  and providing services,  etc. ü  Non-governmental organizations working with victims of human trafficking  and migrant domestic workers implementing advocacy activities for the protection of migrants, awareness raising campaigns promoting the rights of migrants and providing services. ü  Trade unions, migrants organizations working on advocacy, awareness raising and provision of services to migrants. ü  Private agents involved in the migration (recruitment/placement) process. ü  Roles, strengths, and weaknesses of relevant stakeholders.

Only candidates with prior experience in similar research projects should apply and will be considered. Candidates also need to have Excellent knowledge of the (country) policy context, with a particular reference migration and socio-economic development; Working experience with UN or other International Organizations and Donors in the area of research and analytical report development; Excellent (language) writing skills. Candidates should provide at least one example of a written report most similar to the purpose and scope of that described in this TOR.
