Since 2008, civil society led by KAFA – Enough Violence and Exploitation and in cooperation with the National Alliance has been active in the efforts to pass a law on the protection of women from domestic violence. The law was passed by the Lebanese Parliament in April 2014: "The Law on Protection of Women and Family Members from Domestic Violence (Law no. 293/2014)”

The law provided for the establishment of a special fund to support survivors of domestic violence, in terms of emergency assistance, and other assistance such as providing basic assistance for survivors and providing them with appropriate care.

In response to the growing phenomenon of domestic violence among all population groups in Lebanon and the urgent need to facilitate the access of survivors of domestic violence to specialized services, particularly to medical and legal services, the Ministry of Social Affairs, is seeking to appoint a consultant to assist in the development of the constitution and bylaws of the National Fund for Survivors of Domestic Violence, which will be under the supervision of the Ministry of Social Affairs in accordance with Law No. 293 (Article 21).

HOW CAN YOU MAKE A DIFFERENCE?

UNICEF Lebanon, supporting the Ministry of Social Affairs on this initiative, seeks to appoint a senior-level advisor with a strong background in administrative and financial law to support the Ministry of Social Affairs in the development of the constitution and bylaws of the National Fund for Survivors of Domestic Violence.

The consultant will:

Review of articles related to law 293/2014;

In-depth review of the internal system models available at the Ministry of Social Affairs and other ministries for similar funds;

To coordinate with the authorities concerned;

Preparation of a draft constitution for the National Fund for Survivors of Domestic Violence within the time limits set by the terms of reference.

SCOPE OF WORK:

The consultant is expected to support the Ministry of Social Affairs in establishing the statutes and mechanism of a special fund to assist survivors of domestic violence, which will be under the supervision of the Ministry of Social Affairs in accordance with Law No. 293 (Article 21).

The consultant is expected to travel within Lebanon to arrange and organize discussions in the form of focus groups and interviews with key respondents. He/she will also report on progress to the Ministry of Social Affairs,

UNICEF and the Reference Group, which will be called for by the Ministry of Social Affairs with the support of UNICEF through regular meetings.

The consultant is expected to be fluent in Arabic (oral and written fluency), as several meetings will be held with the key informants in Arabic, and many key documents such as policies and laws will be in Arabic.

The consultant will report to the UNICEF Gender-based violence Specialist for daily supervision of the consultant. Reference Group: for general guidance to the consultant.

The consultant will submit a monthly report on: minutes of meetings highlighting key decisions taken and different stages of progress. The report should be presented in Arabic with a copy in English or French.

All reports must be submitted electronically on a USB memory module or CD to UNICEF gender-based violence specialist within the time frame set out in the TORs

Payments will be made when outputs / achievements are submitted in accordance with the time frame set out in the TORs, and based on the validation of results by the Ministry of Social Affairs and UNICEF.

EXPECTED ACCOMPLISHMENTS:

Task 1:Conduct a desk review of material/literature related to law 293, in addition to meetings with relevant persons or institutions and conduct an in-depth review of the internal system models available at the Ministry of Social Affairs and other ministries for similar funds.

Task 2: Consultation with core target groups of the Special Fund by holding a series of meetings with stakeholders and holding individual meetings and / or group meetings in the form of focus groups to discuss the proposed constitution and bylaws and make amendments based on the results of the consultations.

Task 3: Preparation of a draft of the constitution and bylaws of the Special Fund for Survivors of Family Violence and submit it to the Reference Group for comments.

Task 4: Make final changes to the draft constitution and bylaws of the Special Fund based on the feedback provided by the Reference Group

Task 5: Support the launch of the draft as needed.

METHODOLOGY:

Review of material/literature related to Law 293;

In-depth review of the internal systems models available at the Ministry of Social Affairs and other ministries for similar funds;

Sharing of the outline of the constitution and bylaws of the Special Fund with the Reference Group for feedback;

Involvement of the core target groups of the Special Fund through a series of meetings with stakeholders;

Working closely with the Reference Group called for by the Ministry of Social Affairs with the support of UNICEF and composed of administrative, legal and financial experts for consultation and feedback;

Holding individual meetings and/or group meetings in the form of focus groups. The format of the meetings will depend on the consultant's methodology as well as availability of stakeholders concerned;

Preparation a draft of the constitution and bylaws of the Special Fund for Survivors of Domestic Violence within the time frame provided by the terms of reference.

QUALIFICATION REQUIREMENTS:

Consultants are encouraged to ensure that their portfolio (online) meets the qualification criteria required below.

Strong background in financial and administrative law and familiarity with the legal status of women in the Lebanese context to support the Ministry of Social Affairs in constitution and bylaws of the Special Fund for Survivors of Domestic Violence (law 293 (art. 21).

An Advanced (Master's) degree or equivalent in Financial/Administrative Law or related fields.

At least 10 years’ experience in practicing law, review and preparation of laws and regulations from a human rights perspective.

Fluency in Arabic, English or French (written and spoken). Reports will be presented in Arabic with a copy in English or French. Please provide samples of work in Arabic and either French or English

Familiarity with various processes, campaigns and discourse related to Law 293.

Familiarity with the legal status of women in the Lebanese context.

Experience and participation in human rights issues, particularly on issues related to gender equality and gender-based violence.

Appropriate methodology and realistic timeframe for consulting.

مستشار/ مستشارة الصندوق الوطني الخاص بالناجيات من العنف الأسري:

منذ عام 2008، عمل المجتمع المدني  بقيادة منظمة كفى عنف واستغلال وبالتعاون مع التحالف الوطني على إقرار قانون خاص بحماية النساء من العنف الأسري. وقد أقرَ المجلس النيابي اللبناني هذا القانون في نيسان 2014: "قانون حماية النساء وكافة أفراد الأسرة من العنف الأسري ( قانون رقم 293)".

وقد نص القانون على إنشاء صندوق خاص لدعم الناجيات من العنف الأسري، لجهة المساعدات الطارئة، والمساعدات الأخرى كتوفير المستلزمات المعيشية الأساسية للناجيات وتزويدها بالعناية.

إن وزارة الشؤون الاجتماعية، وبدعم وشراكة مع منظمة اليونيسيف ومنظمة كفى عنف واستغلال، وفي إطار التزامها بالعمل على تطبيق قانون 293/2014 واستجابة لتنامي ظاهرة العنف الأسري بين جميع المجموعات السكانية في لبنان والحاجة الملحة لتسهيل وصول الناجيات من العنف الأسري لخدمات متخصصة لاسيما الخدمات الطبية والقانونية والنفسية، تسعى إلى تعيين مستشار/ة للمساعدة في وضع النظام التأسيسي وآلية عمل صندوق خاص لدعم الناجيات من العنف الأسري الذي سيكون تحت إشراف وزارة الشؤون الاجتماعية وفقا لما نص عليه القانون رقم 293 (المادة 21).

الأهداف:

يسعى مكتب اليونيسف في لبنان إلى تعيين مستشار/ة رفيع/ة المستوى ذات خلفية قوية في القانون الاداري والمالي  بهدف دعم وزارة الشؤون الاجتماعية في صياغة النظام التأسيسي والأنظمة الداخلية للصندوق الوطني الخاص بالناجيات من العنف الأسري.

وعلى وجه التحديد، سيقوم/ستقوم المتعاقد/ة بما يلي:

مراجعة المواد المتصلة بالقانون رقم 293؛

إجراء مراجعة معمقّة لنماذج الأنظمة الداخلية المتوفّرة لدى وزارة الشؤون الاجتماعية ووزارات أخرى لصناديق مماثلة ؛ التشوار مع الجهات المعنيّة

إعداد مسودة عن النظام الداخلي التأسيسي للصندوق الوطني الخاص بالناجيات من العنف الأسري بموجب المهل التي تنصّ عليها الشروط المرجعيّة.

الغرض من المهمة ونطاق العمل:

من المتوقع أن يقوم/تقوم المتعاقد/ة بدعم وزارة الشؤون الاجتماعية في وضع النظام التأسيسي وآلية عمل صندوق خاص لمساعدة الناجيات من العنف الأسري الذي سيكون تحت إشراف وزارة الشؤون الاجتماعية وفقا لما نص عليه القانون رقم 293 (المادة 21).

ومن المتوقع أن يقوم/تقوم المتعاقد/ة بالتنقّل داخل لبنان لترتيب وتنظيم مناقشات على شكل مجموعات تركيز والمقابلات مع المستجيبين الرئيسيين. كما عليه/ا تقديم تقارير بشأن التقدّم المنتظم إلى وزارة الشؤون الاجتماعية واليونيسف واللجنة التوجيهية التي سوف تُشكِّلها وزارة الشؤون الاجتماعية بدعم من اليونيسف من خلال اجتماعات منتظمة.

ومن المتوقع أن يتحدث/تتحدث المتعاقد/ة باللغة العربية بطلاقة (طلاقة شفوية وكتابية) حيث ستُعقد عدة لقاءات مع المستجيبين الرئيسيين باللغة العربية، كما أن العديد من الوثائق الرئيسية مثل السياسات والقوانين ستكون باللغة العربية.

سيقدّم/ستقدم المتعاقد/ة تقريراّ إلى أخصائي اليونيسف في مجال العنف القائم على النوع الاجتماعي: الإشراف اليومي علی المتعاقد/ة.

اللجنة التوجيهية: التوجيه العام للمتعاقد/ة.

سيقدّم/ستقدم المتعاقد/ة تقريراّ شهرياّ عن: محاضر الاجتماعات مع تسليط الضوء على القرارات الرئيسية المتخذة ومراحل التقدّم المختلفة. ويقدم التقرير باللغة العربية مع نسخة باللغة الإنكليزية أو الفرنسية.

يجب تقديم جميع التقارير في نسخ إلكترونية على وحدة ذاكرة (USB) أو قرص مضغوط (CD) إلى أخصائي/ ة اليونيسف في مجال العنف القائم على النوع الاجتماعي ضمن الإطار الزمني المحدّد أعلاه.

سيتم تسديد المدفوعات عند تقديم النواتج/المنجزات الرئيسية وفقاً للجدول أدناه، واستناداً إلى المصادقة على النتائج من قبل اليونيسف ووزارة الشؤون الاجتماعية.

الإنجازات المتوقع تحقيقها:

المهمة 1: إجراء استعراض مكتبي للمواد المتصلة بالقانون رقم 293 ولقاءات مع الأشخاص أو مؤسسات معنية وإجراء مراجعة معمقّة لنماذج الأنظمة الداخلية المتوفّرة لدى وزارة الشؤون الاجتماعية ووزارات أخرى لصناديق مماثلة.

المهمة 2: استشارة المجموعات الأساسيّة المستهدفة من النظام الداخلي من خلال عقد سلسلة اجتماعات مع الجهات المعنيّة وعقد اجتماعٍات فردية و/أو اجتماعات جماعيّة على شكل مجموعات تركيز لمناقشة النظام الداخلي المقترح وادخال تعديلات عليه بناء على  نتائج المشاورات.

لمهمة 3: إعداد مسودة عن النظام الداخلي التأسيسي للصندوق الوطني الخاص بالناجيات من العنف الأسرية وتقديمه إلى اللجنة التوجيهية لإبداء لملاحظات

مهمة 4: إجراء التغييرات النهائية لمسودة النظام الداخلي بناءاً على الملاحظات الموضوعة من قبل اللجنة التوجيهية. 

المهمة 5: دعم إطلاق المسودة حسب الحاجة

المنهجية:

مراجعة المواد المتصلة بالقانون رقم 293؛

إجراء مراجعة معمقّة لنماذج الأنظمة الداخلية المتوفّرة لدى وزارة الشؤون الاجتماعية ووزارات أخرى لصناديق مماثلة؛

تشارك مخطط النظام الداخلي مع اللجنة التوجيهية للموافقة عليه؛

إشراك المجموعات الأساسيّة المستهدفة من النظام الداخلي من خلال عقد سلسلة اجتماعات مع الجهات المعنيّة؛

العمل عن قرب مع لجنة مخصصة تنبثق عن اللجنة التوجيهية وتُشكِّلها وزارة الشؤون الاجتماعية بدعم من اليونيسف وتكون مؤلّفةً من خبراء إداريين وقانونيين وماليين والتشاور معهم والأخذ بملاحظاتهم؛

عقد اجتماعٍ فردي و/أو اجتماعات جماعيّة على شكل مجموعات تركيز. سوف يعتمد شكل الاجتماعات على منهجيّة المستشار/ة كما على مواعيد سائر الأطراف.

العمل على إعداد مسودة عن النظام الداخلي التأسيسي للصندوق الوطني الخاص بالناجيات من العنف الأسري بموجب المهل التي تنصّ عليها الشروط المرجعيّة.

 

متطلبات التأهيل ومعايير التقييم الفني:

ترغب اليونيسف في تعيين مستشار/ة يتمتع/تتمتع بخلفية قوية في مجال القانون المالي والإداري والإلمام بوضع المرأة القانوني في السياق اللبناني لدعم وزارة الشؤون الاجتماعية في وضع النظام التأسيسي وآلية عمل صندوق خاص لمساعدة الناجيات من العنف الأسري الذي سيكون تحت إشراف وزارة الشؤون الاجتماعية وفقا لما نص عليه القانون رقم 293 (المادة 21).

الخلفية الأكاديمية :

يجب أن يكون المتعاقد/ة حاصلاً/حاصلتاً على درجة الماجستير المتقدمة أو ما يعادلها من الخبرة في القانون المالي والاداري أو المجالات ذات الصلة.

الطلاقة في اللغة العربية و إحدى اللغات الإنكليزية أو الفرنسية كتابة وتحدثاً. سيتم تقديم التقارير باللغة العربية مع نسخة باللغة الإنكليزية أو الفرنسية. تقديم عينات من العمل باللغة العربية وبإحدى اللغتين الفرنسية أو الانغليزية

خبرة 10 سنوات على الاقل في ممارسات القانون ومراجعة القوانين والأنظمة وإعدادها من منظور حقوق الإنسان.

الإطلاع على مختلف المسارات والحملات والخطابات المتصلة بالقانون 293.

الإلمام بوضع المرأة القانوني في السياق اللبناني.

خبرة ومشاركة في قضايا حقوق الإنسان لا سيّما في قضايا المساواة بين الجنسين والعنف المبني على النوع الاجتماعي.

منهجية مناسبة وجدول زمني واقعي للاستشارات .

المسائل الإدارية

بالاضافة الى المقترح الفني، على المتعاقد/ة تقدّم بمقترح مالي للتكلفة الشاملة مفصّلا التكاليف اليومية / الشهرية (بالدولار الأمريكي) و

التكاليف المقدّرة المتعلقة بالسفرو معدلات بدل الإقامة اليومي  إذا لزم الأمر، لاتمام المهام المطلوبة .

لن يتم النظر في الطلبات المقدمة دون اقتراح فني ومالي.

يجب على المتعاقد/ة توفير الهواتف وأجهزة الكمبيوتر المحمولة.

على المقترح الفني ان يحتوي على عينات من الأعمال السابقة والمراجع وخطة العمل المقترحة والنهج.
